Spread these stories. This is our government “just enforcing the law“ in the eyes of many of our fellow citizens. What a travesty!

Yael Schacher@yaelschacher.bsky.social

I am in Cap Haitien interviewing people deported from the United States. I have been doing this kind of work for almost a decade and it literally does not get more dire than this. People have lost everything they built in the U.S. and are terrified and have no place to go or way to live.

Kimberly Guilfoyle was preparing for her congressional hearing to become U.S. ambassador to Greece when she reached out to a Trump donor with an urgent request: She needed $100,000 that she said she owed American Express—in a way that wouldn't leave a paper trail.

It's hard to imagine a serious effort to fix the federal government that doesn't include court reform. This is not a generic point about bad faith judges. Successful political reform will require the root-and-branch elimination of interlocking con law doctrines that choke off legislative innovation

This thread 👇. @kalimurray.bsky.social suggests BFS should become a leg branch agency (not subject to presidential control). Yes. Another option is to (re)protect some agencies from direct pres interference. But ANY of this requires remaking admin law—which SCOTUS has gutted.

Mike Johnson, reacting to Trump’s pledge of $5,000 to adult citizens if the Republicans retain Congress, said Trump was just “brain storming.” Johnson has found a new way to call “BS.”

There's no sugar-coating Slaughter. It's an enormously important ruling (far more important than the other three decisions #SCOTUS handed down today). It's a huge win for Trump/the executive. And it's going to have massive ramifications for the functioning of the government long after Trump is gone.

John Roberts' Constitution forbids any attempt to proactively ameliorate racial discrimination and racial inequality, but permits open racial discrimination as long as there is a facially neutral explanation available, even if it isn't remotely plausible. This, my friends, is "Colorblindness."

Presidential emoluments, presidential emoluments, unconstitutional presidential emoluments.

Not enough people are talking about this. A Florida airport was renamed after Donald Trump. He walked away with the trademark, the licensing rights, and a deal that lets him profit off every piece of merchandise sold there. www.theguardian.com/us-news/2026...

Given that the IRS leaked every taxpayer’s confidential information to DOGE in January, 2025, shouldn’t the settlement funds be returned to the Treasury because we were all victimized by this government?

The way our nation turned its back on those who helped us at great risk to themselves and their families is an unforgivable national shame. We owed Mohammad Nazeer Paktyawal. Instead, ICE arrested him in front of his children and he died in their custody. We failed him and his family.

If the Supreme Court decides to attend the State of the Union speech (something I’ve been against), there may be more than one Justice mouthing words at the president, and those words won’t be as mild as “Not true.”

So SCOTUS, with its fabricated-out-of-thin-air immunity doctrine, has actually made American presidents less accountable than LITERAL royalty.

Fantastic piece from @stevevladeck.bsky.social & @barryfriedman1.bsky.social on how to hold federal law enforcement accountable. As they note, an even better solution would be for Congress to codify Bivens.

Steve Vladeck@stevevladeck.bsky.social

In today's @nytimes.com, @barryfriedman1.bsky.social and I argue that, with no *other* means of pursuing accountability for lawlessness by ICE, local/state prosecutions become not just legally viable, but necessary—both to punish past abuses and to deter future ones: www.nytimes.com/2026/01/26/o...

i think powell's response here is a demonstration of the folly of the idea that democratic accountability requires presidential control. what if the president is not acting in the public interest? you want independent agencies to be able to push back and pursue their *congressional mandate*

Powell, showing more guts than almost any GOP legislators: "The threat of criminal charges is a consequence of the Fed setting interest rates based on our best assessment of what will serve the public, rather than following the preferences of the President." www.federalreserve.gov/newsevents/s...

It would be difficult to overstate the amount of anxiety in the Twin Cities now. The invasion of ICE is not limited to ethnic enclaves in the inner cities; suburban Targets and church parking lots are staging areas. The hatred and fear are palpable, but also the administration’s goal.

By stoking them, it’s hoping for retributive violence against its agents, in order to provoke whatever can be called an insurrection requiring an “appropriate” reaction.

Read this morning about the USPS not postmarking on the day a letter is mailed unless you request it at the post office. I’d like to see serious analysis of how this will affect absentee voting. My guess is that it will disenfranchise many.

The CBS investigation portrays a modern concentration camp, similar to the Soviet GULAG (like CECOT, an acronym): sadistic guards, 24 hour lighting, isolation cells. Americans once opposed this inhumane system. The Trump administration sent innocent people there to suffer.

Article I is inoperative, haven’t you heard? The Supreme Court has replaced it with some Hamilton quotes about an energetic executive, and Congressional Republicans are afraid of primaries.

Correction, David Axelrod - Janet Mills would not be the oldest person sworn in as a freshman to the US Senate. That distinction goes to Rebecca Felton, sworn in at age 87 in 1922. She served one day.

Granted I’m a neophyte at this con law stuff, but why do the more conservative justices worry so much about presidential power while they seemingly care so little about Congressional power exercised with presidential blessing? And why is separation of powers formalism valued above flexibility?
