Setting aside the incredibly dangerous and fascist aspect of this, is there actual evidence that Khalil was a “Hamas supporter”? Or is the standard for a green-card holder being sent to a secret location and possibly deported just “critical of Israel”?

So apparently the standard is “activities aligned to Hamas,” so the answer to my first question would, as could have been predicted, be no.

UPDATE — new response from DHS: DHS claims that "Khalil led activities aligned to Hamas." Says ICE arrested Mahmoud Khalil in coordination with the State Department and in support of Trump's executive orders.

Per request of AIPAC and the ADL. They've tracking every protester on the streets and online since Oct 7 and sent them to businesses who put them on their "no hire" lists which they also posted online. Anyone who protests against genocide is automatically labeled a Hamas agent/terrorist.

Good point-- I think the legal word for this is ex post facto, as in: > No Bill of Attainder or ex post facto Law shall be passed. Article I, Section IX, US Constitution

He distributed fliers defending 7.10 while occupying a library; it's an open and shut case of Title VI if Columbia doesn't kick him out of campus (and of course Trump isn't bothering with the Title VI case and instead cutting grants). But is it material support? Not unless other evidence comes up.

This is also a sincere question: I see a difference between being critical of Israel and being an anti-semite, but can you be a supporter of Palestinian rights and not be a supporter of Hamas? I also think I know the answer.

Yes, of course. For example, I think there should be an independent Palestinian state. I do not believe Hamas, as an organization, should run it and I don't believe they should engage in terrorism. See? Easy.

I haven’t seen any evidence of connections to Hamas. It’s possible they are going to argue either: 1) His advocacy constituted material support for an FTO (seems hard to prove), 2) He should be deported on national interest grounds pursuant to a rare Cold War-era ground of deportability.

Usually material support is literally more substantial than expressing an opinion. Providing/designating money or raising money to a terror group for terror operations, providing "material" (phones, guns, tents etc). It's roughly analogous to the concept of providing assets to facilitate crime. 1/

They said his visa was revoked. He said he has a green card. They stared and claimed then, that the green card was revoked. It was to get their hands on him to traumatize him in any case. ICE isn't for efficiency, it's a scare tactic and a machine to break human rights and leave aftermath to others.

This doesn't sync up because Republicans swing Nazi torches every day of the week but no one with any power goes "hey maybe we should stop those Nazis". It's kind of weird that democrats are threatened for stuff they didn't even do, mean while republicans can do it on stage and people protect them.

See, the thing is, it would seem I’m as much a “Hamas supporter” as this man, and so are many people I know. And if these clowns can arbitrarily revoke a Green Card, they can arbitrarily revoke American citizenship. So ICE could conceivably disappear me as well. Or you. Or your parents or your kids

Well, a lot of people's "criticism of Israel" is just straight up racism and bigotry, so it's not impossible that he does support it. However, an idea is not a crime. It's evil and shitty, but it's not a crime and shouldn't be. So the actions they're taking against this student are unacceptable.

I agree such a claim must come with evidence. Providing material support for designated terrorist organizations surely violates the conditions for a green card. HAMAS is a DTO. What constitutes material support? I don't know if advocacy, slogans, propaganda is enough. But what about fundraising?

The problem with this administration is it's full of untrustworthy liars. The problem with HAMAS is they are enemies of Palestinians more than they are enemies of Israel.

Did he take part in the violent takeovers of buildings at Columbia and Barnard? That's enough for deportation as far as I'm concerned. Because those takeovers were violent. Or is the standard for Philip Bump that violence is okay if it is in support of destroying Israel and killing Jews?

One of the early lines, where people still aren’t speaking up because the regime is coming for people they disagree with politically, and therefore they think the victims deserve to be targeted. The point of the poem is that by the end, the Nazis turn on each other.

if you take the side of russia against ukraine like many of our elected officials-they should be exiled from this country-there is more evidence that trump himself is a terrorist-he praises china, russia, hungary, all authoritarianism-trump has violated his oath to america-remove him from office!

No due process. No free speech. Just don't like what he says so off to the camps with him. Who's next? People who promote abortion or trans rights? Equal voting rights for Black people? Jews who criticize Israel? People who condemn Elon Musk? These are Gestapo tactics.

Sincere question: where are all the protesters that were marching during the election? Shouldn’t they be marching on Washington & Mar A Lago instead of Columbia Uni? I’m seeing critiques of Dem voting for Rubio as Sec of State, but no protests at Rubuo’s office. Feels like I’m taking crazy pills.

If INA 237(a)(4)(C) is the ground of removability, then Rubio must personally determine that Mr. Khalil’s removal would “compromise a compelling United States foreign policy interest,” and must notify Congress and explain his rationale. But the removal *process* would not be different or expedited.

Interesting before the Court. Perhaps a case of first impression. Trump wants to deport a visa holder to Palestine, while Trump is actively conspiring to remove all Palestinians from Palestine. So Trump can steal their land, "Gaza belongs to me"

This is such a slippery slope. No matter your views, or faith, this is very wrong and scary. Tourists detained, migrants sent elsewhere out of sight, now a green card holder, whose spouse is a citizen and pregnant. How many more?

the president led an assault on our Capitol and nothing happens. There are folks in our country supportive of the orange chucklefuk helping Russia kill Ukrainians. but a citizen that may or may not support Hamas gets citizenship revoked instantly? Because someone said so? 😡

FAFO. This is who he is, from AP: "helping to organize an “unauthorized marching event” in which participants glorified Hamas’ Oct. 7, 2023, attack and playing a “substantial role” in the circulation of social media posts criticizing Zionism, among other acts of alleged discrimination."

For this to even be the pretense for DHS bringing a charge to revoke his green card, which he’d get notice of and have due process before a judge, it would have to be material support and not just vocal sympathy. Not saying hes even done that but the bar is so much higher than “support”

We need a serious reflection on where our party focused, not an ideologically comforting excuse, or we will continue to lose to the MAGAs. Ignore it at your peril and cast aspersions but we are in trouble because of not being honest

If only Trump were a mediocre white man. He doesn't even rise to that level, and he knows it. He wants to believe himself the best, and it gnaws on him every moment of every day that he isn't. So he lashes out like this, because hurting others distracts from the truth for just a little bit.

I don't you get a day in court if you've been disappeared. I saw that article first thing this morning, was chilled and sick to my stomach, and said that's enough "news" for today. Another country and generation asking, "How do you know when it's time to leave?"

How is this legal? Perhaps if one is sending money or materials to Hamas because it's on the US terrorist list. But advocating for Palestine isn't the same as assisting Hamas. More nazification every damned day!

Who the f- cares if he did support Hamas? The strongest resistance Palestinians have? When your oppressors/abusers are relentless - what are you supposed to do? No one in the world is coming to Palestines aid to fight back against Isrhell.

I know we have our reasons (political, economic and religious) to support Israel. As a people I have nothing against them personally. But I need someone, anyone, to explain to me why I need to support a country who's Gov't is cruel, obsessed with death and it's people barely flinch at their actions

I'm sorry. But while we as a nation have zero right to criticize other countries who have little regard for life in general (I am well aware what we've done in Afghanistan and Iraq and even in our own streets), even we have standards and don't just pridefully display our cruelty to the world.

My understanding is that Israel is important due to it's biblical significance and it's people have been the target for thousands of years. I get it. Does that mean we just pretend they are not just killing indiscriminately? Abusing a people because they can? Out of revenge?

Israel is important because it's the US's client state in the Middle East. It was brought into existence to keep the Soviets and away from Middle Eastern oil. America knew Jews were being murdered years before entering WWII. It didn't and doesn't care about Jews or their "homeland"

At what point do we put our foot down as the country we are (the richest, most powerful), as the bank account we are to their weapons needs and stop the random killings of innocent people? Is this who we truly are? Excuse makers? Death justifiers? "They're all the same" believers?

I used to conduct research in a human rights field and it was scary how often the IDF identified any dead Palestinian as a "terrorist" - no investigation needed. Smart people should be VERY cautious about believing the label that ICE slaps on anyone. Assume innocence. It shouldn't happen to anyone.

Playing fast and loose with the law, if you ask me. And this is exactly what Joe Biden was *actually* sent to Ukraine in 2015 to fix. The crooked Prosecutor General was filing flimsy charges against the administration's enemies and ignoring their crimes. Now it's happening here. Huh!

We are at a most terrifying inflection point and it is likely that more and more freedoms will be curtailed daily while the Republicans revel in christofascist destruction of our fragile democracy. McCarthyism feels quaint by comparison to what Trump and his myrmidons are doing. Then there is Musk…

If you don't hang a picture of Netanyahu in your living room, you're a terrorist I guess. The split second I set foot across the US border, I'm getting arrested, solely based on the skeets I made previously.

I believe we lose ground when we allow them to frame this as whether or not he is a Hamas supporter. He (and WE) should be free to voice support for whomever we choose without fear of government reprisal. Period. End. Do not concede ground on this.

So a Palestinian protesting that Israel cut off food supply and electricity to Gaza can be evicted on the charge “Hamas supporter”? The US is on a very bad and dangerous path..

WTF, you can't do that! People here have the right, set forth in the 1st A, to love, hate, support whatever group and express it so long as there is no actual incitement of violence. Please, Khali, hook up with good lawyer and head to nearest federal district court.

This non-U.S. citizen led a group that actively *urged Democrats not to vote for Kamala Harris.* I’ve lived abroad several time and I never once stuck my nose into the electoral process of my host country.

Being a permanent resident is a higher level of commitment, though. For one thing they are permitted to donate to a political campaign. Also you can be drafted (when, not if, there is a draft).

The Palestine stuff was always their foot in the door to unravel civil liberties and freedoms and way too many Dems went along with steps toward this because of the cynical lie that it was about antisemitism

Palestine was the final nail in the Dem narrative to me. Republicans can do whatever they want because Democrats will do whatever they can to never draw eyes to the atrocities that Israel commited. Now they will just let Republicans walk all over what they want. They lost what defined them, empathy

I just don’t get that though. Just because you want Palestinians to have a homeland and Israel not to commit genocide doesn’t mean that you are anti semitic. Israel has a right to exist, but so do the Palestinians.

Even if he does have such connection - just for the sake of argument -- there is STILL DUE PROCESS. He is entitled to face his accuser and have a chance to rebut the evidence. Not jsut told "wrong think, off to black site."

What do the Republicans say about this? Oh, stupid question. As always, they will applaud and wave their flags and think everything the Trump administration does is great without question.

The short answer is "probably but we don't know." He was allegedly active in (and maybe a leader of) Columbia University Apartheid Divest which, as the NY Times reported, stated "We support liberation by any means necessary, including armed resistance" and more.

If you're asking if he sent money etc. to Hamas, the answer is "probably not" and there is no clear, available evidence to the contrary. My guess is that his support was limited to rhetoric and speech-adjacent stuff like leading the encampment.

Many, many people sincerely believe that all Palestinians are terrorists, or supporters of terrorists, based solely on the existence of Hamas. If you accept that interpretation, than anyone protesting for Palestine if clearly a supporter of terrorism, specifically Hamas.

no hun, some people literally remember the two intifadas, munich, the plane highjackings, siding with saddam in kuwait ..and all the "fromn the river to the sea" chanting isnt exactly helping either.

It’s not a crime to say publicly you support Hamas (even though I don’t believe he actually has even done that?). Freedom of speech and all that. Seems weird to try and revoke someone’s green card for doing something that is literally Constitutionally protected.

Immigration law is tricky here. If they can prove he advocated for positions "against the national interest" OR provided support (even a GoFundMe to a Palestinian who was part of Hamas), there's a legal case to be made. That said, just snatching him is blatantly illegal.

You think so? You must be a very laid back guy.😊 The legal stuff was posted elsewhere but I don't know if ICE or Sec of State working off an executive order actually needs a warrant? They are saying he was a Hamas supporter and going to paint him as a terrorist threat by sounds of it.

Or the US is going to take people and detain them as "hostages" for leverage for when "all hell breaks loose". I won't be surprised if we start hearing "enemy combatant" even though this is an immigration issue.

Are you not aware that to Netanyahu, the ADL, and apparently the US State Department, supporting the right of Palestinian children to not die under a pile of rubble IS being a Hamas supporter?

The US has been doing evil around the globe for decades and naming those who oppose it as terrorists... I appreciate that Hamas does some evil shit, but if I lived there I'm certain I'd join them. How else do you fight back against a genocidal occupying force? 🤷🏽‍♂️
