Demonstrators gather outside the Royal Courts of Justice as the trial against the London gold market begins. The case is brought by families of two Tanzanian men, both aged 23, killed in separate incidents. What are the legal arguments all about? See thread 📝

‘Responsible gold’ on trial – Week 3 of the LBMA case What happens when human rights warnings are repeatedly raised, but the gold industry's accreditation system continues to provide assurances on paper? Here is what happened in Week 3 ⬇️ raid-uk.org/responsible-...

🔹 Why did accreditation continue? Asked about it, Crowell called it “a nuanced decision”. LBMA’s Sakhila Mirza accepted that OECD guidance could require suspension of sourcing or a time-bound mitigation plan in serious cases. LBMA witnesses emphasised that their role is not to “audit the auditors”.

The wider question: When mine operators, refiners, auditors and accreditation bodies each point to the limits of their responsibilities, who ensures that serious human rights risks are actually addressed? The trial continues. See our full analysis from this week: raid-uk.org/responsible-...

🔹 Industry influence and conflicts: Evidence examined the role of the gold refiner’s parent company in shaping LBMA guidance, overlapping board positions held by industry figures, and questions about MMTC-PAMP’s original accreditation process.

🔹 RAID’s warnings: RAID called for MMTC-PAMP’s suspension in 2020. Further allegations were considered by an LBMA panel in 2022. LBMA’s CEO Ruth Crowell described North Mara as high risk but on “that line in between” high-risk sourcing and a zero-tolerance breach.

🔹 Who knew about North Mara? Senior LBMA officials said they were unaware of allegations concerning the mine before 2019, despite years of public reporting, RAID investigations and Tanzanian parliamentary scrutiny.

🔹 Who scrutinises the auditors? The court heard that MMTC-PAMP was recertified in July 2019 without LBMA obtaining an auditor's management report as required under its rules. The claimants also questioned why LBMA had not examined underlying mine reports and risk assessments during its review.

In case you missed it, the case was brought by families of two young men allegedly killed by police guarding the mine in 2019. The LBMA denies liability. Learn more in the thread below.

🔹 Police accountability: Former mine security described the limits of mine-level investigations. Security officer R. Duncan suggested the mine could have exercised more influence over police conduct. A. Hughes described a separate shooting of a fleeing man as “a homicide”.

Week 3 of the High Court trial against the London Bullion Market Association (LBMA) examined alleged police violence at Tanzania's North Mara gold mine, the independence of responsible-sourcing auditing, and the decisions that allowed gold refiner MMTC-PAMP to retain its Good Delivery accreditation.

🔹 Did buyers rely on the LBMA? Both sides examined correspondence involving tech giant Apple. While the defence highlighted Apple's own due diligence, the claimants pointed to emails where Apple had sought assurances from the LBMA about conflict-free gold.

Week 2 brought a central question into sharper focus: when responsible-sourcing standards are aligned with international guidance, who ensures they deliver meaningful results in practice? Learn more about the legal arguments in detail on our website: raid-uk.org/responsible-...

🔹 Who is responsible for due diligence? The LBMA stressed that companies retain responsibility for their own supply-chain checks, even when participating in certification schemes.

Expert witness Joseph Wilde-Ramsing from @somoamsterdam.bsky.social agreed about companies doing their own checks, but warned that they can treat certification as a substitute for independent scrutiny. Such schemes, he said, should be “a piece of the puzzle, not a proxy”.

🔹 Who checks the auditors? The court heard concerns about whether the LBMA receives sufficient information from independent auditors to meaningfully assess their work.

When the defence, the LBMA, described successive improvements to its guidance as “tighter, tighter, tighter,” expert witness Christoph Wiedmer questioned whether the controls were actually “good”.

The exchanges raised questions about the use of force against people seeking livelihoods in communities affected by large-scale industrial mining.

🔹 Responsible-sourcing standards under scrutiny: The LBMA emphasised that its Responsible Gold Guidance (RGG) aligns with international @oecd-ocde.bsky.social standards. Yet expert testimony questioned whether compliance on paper translates into effective protection against human rights abuses.

Defendants highlighted inconsistencies between witness statements and earlier interviews conducted by civil society organisations, including RAID & @miningwatch.bsky.social. They also questioned the absence of medical and post-mortem records; witnesses explained why such records are hard to obtain.

🔹 Trespassing accidents or excessive force? Defence questioned whether deaths resulted from police violence or from accidents in dangerous mine terrain, emphasising unlawful entry and alleged gold theft.

🔹 LBMA denied it was negligent: It argued that the alleged unlawful killings involved Tanzanian police, over whom neither it nor the refiner had control. It did not own, operate or supervise North Mara, and therefore has no duty of care to the claimants.

🔹 The claimants argue that had the LBMA suspended the refiner’s accreditation, or threatened to do so, thereby removing it from London’s lucrative gold market, it would have created powerful commercial pressures to end the violence and prevent the two deaths.

🔹 LBMA does not certify mines: It said it certifies refiners’ due-diligence processes and relies on independent auditors. It argued that suspending the refiner MMTC-PAMP would not necessarily have stopped the violence: the mine could have sold gold elsewhere.

🔹 Flawed responsible-sourcing standards: The claimants argued that the LBMA developed its own industry-led responsible-sourcing scheme but then failed to properly enforce it. They accused the LBMA of accepting what their barrister called “vacuous” reports and inadequate audits.

🔹 Refiner accountability: The claimants argue that its certification of MMTC-PAMP – Indian gold refiner, part of the Swiss MKS PAMP group – effectively “cloaked” the human rights problems at the mine and discouraged other international buyers from conducting their own independent investigations.

🔹 Both sides made their opening statements. The Tanzanian claimants are represented by barrister Dominic Grieve KC, while the LBMA, the defendants, are represented by barrister Geraint Webb KC.

🔹 LBMA accountability: The claimants highlighted that years of reported shootings at the North Mara gold mine had been ignored by the LBMA. Families of those who died argue that weaknesses in the implementation of LBMA’s RGG allowed tainted gold to be wrongfully labelled as “responsibly sourced”.

A further 30 people have joined the legal claim against the LBMA, bringing additional allegations of killings, severe woundings and torture by security forces at North Mara. Those claims have been paused pending the outcome of this trial.

The case raises fundamental questions about the credibility of “responsible sourcing” in the global gold trade – and whether voluntary certification schemes can provide meaningful protection against human rights abuses.

🔹 Whether there was a conflict of interest involving the LBMA board, including gold refiners and gold companies sitting on the LBMA's board at the material time. And whether there was a conflict of interest in relation to the initial drafting of LBMA rules and procedures by gold refiner employees.

🔹 Whether effective action could have been taken to address alleged human rights abuses at North Mara if the LBMA had taken steps to decertify the gold refiner MMTC-PAMP.

🔹 Whether the LBMA should have certified the refiner sourcing gold from North Mara as producing “Good Delivery” gold under its scheme, which is intended to ensure that only “conflict-free” gold enters the market.

🔹 Whether the LBMA should have delisted refiners processing gold from North Mara until appropriate steps were taken to address alleged patterns of serious human rights violations at the mine.

For years, rights groups have raised serious concerns about weaknesses in the London Bullion Market Association’s (LBMA) responsible-sourcing programme. We have argued that the “clean gold” label has been used to whitewash abuses. Now, Tanzanian families are suing the LBMA.

The trial (7 Oct to 20 Nov) will examine: 🔹 Whether the LBMA owed, and breached, a duty of care to two miners who lost their lives at North Mara. 🔹 To what extent downstream companies, bullion banks and others in the global gold market rely on LBMA certification as part of their due diligence.
