If you're a business or artist with intellectual property, watch the clock. 7 days until Meta is 3wks from claiming right to scrape your site to develop its AI. Your consent? Apparently unnecessary. All it takes is use of Meta's services. Yes, they delayed but you shouldn’t.

Reading thru an ex-Google exec's deposition unsealed last night, these excerpts stopped me cold. Brings questions of IAB's independence, especially given its silence on Google's antitrust violations. And little hope it'll speak up about Meta's sweeping new commercial terms. 1/2

Simply imagine a Lockheed, Boeing or other prime defense contractor - out of nowhere, no communication - implementing some terms of service or term in a contract they think they have without reaching out first to say we think you are violating this. As a result we will nerf your crucial technology.

Seems fairly obvious this is a must do when you read the sentence aloud, “Lawmakers in the U.S. from both parties have called for a formal probe into Musk and SpaceX over alleged unilateral changes the company made to its services in Ukraine.”

Musk said he restricted Starlink in Ukraine- causing fast moving drones to lose connectivity - and that he had every right to do so because of some terms of service or contract that he didn't show us. (He didn't address suddenly doing this with no warning to Kyiv.) www.cnbc.com/2026/10/24/u...

whoa, it gets worse. In the Meta securities lawsuit for Cambridge Analytica cover-up, plaintiffs just posted deposition list. If they have the courage to 'go to the mat' (as Zuckerberg says) like New Mexico AG has done for over $25B, this could be very, very bad for Team Zuck. 1/3

Basically, they have all the right people: Sandberg, Bosworth, Kaplan, Schrage, Stone, Chancellor, Hendrix, others to get to bottom of who knew what and when. Kaplan/Sandberg/Zuckerberg named in suit, last two have sealed SEC depos to compare record. 2/3 storage.courtlistener.com/recap/gov.us...

Congratulations, New Mexico. Everyone else, I believe Meta has succeeded in deflecting one of the great cover-ups of all time. That includes the actual knowledge timeline, the breadth by delaying sealed audit reports Zuck promised Senate until everyone moved on, Sandberg’s SEC depo still sealed…

No one seems to be paying attention to this either (too much going on!) but I think FTC has a good shot at winning appeal on their antitrust case to break up Meta. Final briefs were just filed in DC. FTC argues (1) timing and (2) TikTok analysis was wrong. I totally agree. /1

The more important FTC argument though was why TikTok mattered. Court determined Facebook no longer had a monopoly when he wrote his opinion. That's odd. Makes no sense. FTC argues what matters is monopoly on date complaint filed, not years later when court decision happens. /5

I've made this point for years since all of Facebook's troubles started in 2017-2018 and its reputation went into the tank. If Instagram was a separate company, how would it have acted? It would have destroyed Facebook, gone for the jugular, competing on privacy/quality. /3

This is a timely argument considering the $25 billion judgment against Facebook today for violating its users privacy rights in the cited scandal. Yup, everyone kept using the service due to its market power in Personal Social Networks (friends and family sharing). /4

On (2), Meta had shown evidence when Meta went down for a day (years after FTC filed complaint) users flocked to TikTok proving TT is a competitor to Facebook. But FTC had established relevant market as friends and family social networks and TikTok is all short-form video. /2

Today, a judge in New Mexico ordered Meta to pay $25 billion for misleading users on data privacy and a range of other statements that a jury deemed deceptive (and willfully so). Last month I broke down the jury's determinations on each of the questions posed to it:

techpolicy.pressEight Years On, Cambridge Analytica Scandal Catches Up With Meta in Santa FeA jury found that Meta—then Facebook—misled the public in statements about Cambridge Analytica and its policies on hate speech, violence and misinformation.

This appears to be the (nonsensical) statement Meta has provided to all major outlets about the $25B fine which had to do with an unprecedented data leak that they then kept under wraps through the 2016 election until scandal broke wide open in 2018. Tax on speech? Spin, spin 1/2

If it were me, I wouldn’t even publish that statement or I’d ask for another one as it’s deceiving your readers. Probably required chief legal officer to get it published. Also, all press should be mentioning related DC cases which include naming Zuck personally. SEC 👀. 2/2

The word “Cambridge" appears 45 times in the $17 billion Meta child-harms settlement, notes Jason Kint. Buried inside: a $459,293,017.80 payment resolving Cambridge Analytica claims across at least 46 states and two territories.

Thanks for flagging this. There are a ton of journalists who unfortunately have been spun by Meta PR on the various cases over the many years while Meta has fought to keep facts buried (Sandberg/Zuckerberg SEC depos, knowledge timeline including board). Zuckerberg named in DC AG case.
