‼️ Why this matters: Where we grow has consequences for our climate, our farms, and our water. Climate planning only works if it leads to real changes in how we build and grow. That’s what the Growth Management Act asks counties to do.

‼️ What's next: Our legal team will proceed with reviewing all the public records for completeness & drafting pre-hearing legal arguments due early next year. The oral argument hearing is tentatively scheduled for February 8, 2027. We’ll keep you updated as the case moves forward.

➡️ 2. The plan doesn’t do enough to address climate change. As we saw in our recent Thurston County case, aspirations aren’t enough. WA comp plans MUST include meaningful climate action. Whatcom County's plan doesn’t identify the actions needed to reduce GHG or equitably address climate resilience.

➡️ 3. The plan fails to preserve water resources. Our appeal also raises concerns about the County’s approach to permit-exempt wells and water resources.

Earlier this summer, the County adopted its required ten-year update. There were some meaningful improvements made in this plan (to learn more about them, check out the latest blog post from our friends at @re-sources.bsky.socials ⤵️). But it still falls short of meeting requirements under the GMA.

There are 3 big problems at the heart of our appeal: ➡️ 1. The plan directs urban growth into farmland, floodplains, and rural areas. Sprawling development comes with real costs. It puts farmland and habitat at risk, while increasing greenhouse gas emissions.

This decision will also benefit our legal team's work across WA state. As counties finalize their comprehensive plan updates in the months and years ahead, Futurewise can use this outcome to hold them accountable to adequately and equitably planning for climate change.

On Aug. 17, the Growth Management Hearings Board made their decision – and agreed with us on 2 out of 3 arguments! They found that the County’s plan fell short of adequately addressing current climate threats with measurable policies, specific actions, or development rules – and doing so equitably.

Why this matters: 📌 This is the first real test of HB 1181, a new WA law that requires cities & counties to plan for climate change. 📌 This outcome sets a standard for what that climate planning must look like: measurable policies and actions that are built to work, not just sound right.
