Patent, trademark, & other IP lawyer (some business law, too). I 🖤 rock & roll, punk, animals, conlaw, & horror, & I'll talk your ear off about all of that. I'm not your lawyer. This isn't legal advice. This is Radio Clash. https://linktr.ee/kingpatentlaw

My podcast, "Avoid the Legal Horrors with Julie King: Patent, Trademark, and Business Strategy," is on Spotify, Apple Podcasts, Amazon Music, etc. & YouTube (@kingpatentlaw). Useful topics with occasional costumed Spooky Season stuff. #trademark #patents #ipsky #iplawsky #lawsky #iplaw

Did you know the USPTO converts all patent applications to TIFF files? We submit a DOCX application per their requirements and a PDF backup and they do a shitty conversion to TIFF and examine that. Make it make sense. Oh, you can't? No, you can't.

Another reminder that AI is like a decent junior associate. It gets a lot right, but it makes mistakes. Today mine cited case law that was recently overruled by a case that set a new test for patent obviousness. Most things the AI trained on cited the old case because the new case is relatively new.

It makes sense to me why this error was made: the ratio of work citing the old vs the new taking precedence over the recency of the work citing the new. I'll be updating the AI instructions to favor more recent citations when appropriate accordingly. But it will still make mistakes.

This kind of error is why we check the work of junior associates before filing and why we must check AI work before filing. It sounded great, but I knew it was the wrong test because I'm an experienced human lawyer.

@hostgator.bsky.social can kiss my ass. Their tech support won't help when you get hacked unless you pay SiteLock. Which apparently didn't fix the problem the last time I went through this. I pay for business hosting and expect proper tech support. Claude is helping me more FFS.

I filed and got a victorious conclusion to a trademark opposition in less than an hour this afternoon. Freaky, but in a good way! Probably should buy a lottery ticket.

Favorite AI-generated podcast transcript error so far, especially since it has never fumbled on this word before: Atternees Too late to add that as an anecdote in the recording, but it's definitely going in the accompanying blog post, since it's all about AI and the practice of law 😁 #lawsky

I'm excited about next week's podcast episode. I've already had some colleagues ask me to help train them on proper AI use for lawyers. Maybe I have a side hustle in the making. I love this stuff. Eons ago I trained people on litigation support software and how to use Westlaw in its digital infancy

I'm finishing up a 20-minute video and blog post about attorney use of AI and how way too many posts about the recent Heppner decision are misinterpreting the ruling. I felt a need to add in the beginning why I'm qualified to speak on the subjects. I wonder if I were a man if I'd have felt that. 🤔

@budzinski.house.gov are you making a firm stand that Donald Trump should be removed from office via 25th Amendment or immediate impeachment and conviction? That's what most of your constituents want after he threats this morning. Please do ASAP if not already done. I'm from 61821 and you can DM me

I'm proud to have my signature on the excellent amicus brief from solo and small firms by the marvelous Carolyn Elefant. I got to meet her and thank her for her work in person last week after "knowing" her online for a while.

Kendra Albert@kendraserra.bsky.social

It's the amicus deadline in Perkins Coie LLP v. DOJ (the law firm EO appeal that DOJ tried to drop and then changed its mind). On the DOJ side, there was one amicus brief signed by five conservative orgs. (storage.courtlistener.com/recap/gov.us...) On the side of the law firms we have...

I am ordering more of Riki Rachtman's delicious Cathouse Coffee. Do yourself a favor and try it. Yes, the host of Headbanger's Ball has turned me into a coffee snob. That's ok. He's super nice. Go see his spoken word show if you can, too. Inspirational and funny.

Reading lawyers who clearly haven't read the Heppner decision fight on reddit about what it said wasn't a good idea for improving my mood. However, I'm working on 2 posts/videos about AI, 1 about AI & IP for small businesses & 1 about AI & the legal profession for lawyers, so good fodder. #lawsky

I want a practice management platform that is designed for transactional lawyers, handles leads and matters without switching from one system to another, has siloed AI that's actually good, and handles my social media posting. Please design asap, thanks! #abatechshow #lawsky

This is clearly the kind of wise and eloquent jurisprudence every young lawyer aspires to.

Alito: "We have lots of phrases that involve 2 words, second of which is 'day.' Labor Day, George Washington's birthday, Election Day. They're all particular days. So if I have nothing more to look at than the phrase 'Election Day,' I think this is the day in which everything is going to take place"

Just SUPER thrilled the @americanbar.org released my email address to all the Tech Show vendors a good week before the conference so my inbox is flooded with unsolicited "stop by our booth" emails. Also, dear vendors, that is how to guarantee I will not be stopping by your booth.

Always a pleasure when a call with attorneys for other involved parties (I hate calling them opposing counsel when they really aren't) is surprisingly pleasant and nonadversarial. Civility and collegiality in our profession are underrated. #lawsky

Legal colleagues, tips on how Claude CoWork or Code can make my transactional practice more efficient? I already have it helping me manage my patent and trademark docket. I'm fairly adept at regular Claude and use a paid version.

Reworded second comment also not published. Wtf? Here it is: There's nothing in there any more critical of the current DOJ than in many other comments that have posted. Are comments not processed in the order received, maybe?

Julie King@kingpatentlaw.com

I find it interesting that my comment on the proposed rule that would allow the DOJ to circumvent state bar discipline procedures hasn't been published when many others submitted after mine have been. Submitted again, dammit. No profanity or threats or nuthin' in my comment. Just typos haha.

Damn skippy on both points. This is a big deal and good news on a bad news day.

Today was an important day for the opposition movement. The law firms that stood up against Donald Trump threats won. Those that capitulated and collaborated with Trump will need to explain to their families, clients and future generations why when democracy was at stake they were such cowards.

Man, I think about the lengths I go to to protect my clients' confidential and privileged information and there's POSOTUS & his gang of evil idiots playing war in a "war room" made of CURTAINS and taking photos of sensitive docs for their social media posts. Makes me wonder if anything of real 🧵1/2

Substance is actually discussed in front of him in his play war room and if any of the maps and docs have accurate details or are just to enable them all to pretend he's really involved. Otherwise it's gross negligence of the highest order. 2/2

Holy Emoluments Clause, Batman! Trump's trademark application filings regarding airports, were they to be granted, would put him in a position to demand licensing fees from the federal government for use of the marks if they cave and name any airports after him. That is wildly unconstitutional.

Not that the Emoluments Clause isn't already lying bleeding to death in the middle of the street, along with the rest of the Constitution.

Why tf do people keep putting me on lists that say I'm anti-AI? I did my masters degree project on AI, ffs. Maybe it's because I understand its limitations? "Techno-pessimist," my ass. This is why it's dumb to block people based on any list you didn't create.
