The Trump DOJ citing the *preamble* to a 1993 federal law about voter registration for the proposition that Trump can demand that federal judges preemptively overturn an election result is, even in Trump DOJ-adjusted terms, one of the craziest legal arguments I've ever read

This headline says Democrats are "fracturing" on trans rights because *voters* are demanding an "affordability" focus, but there are no facts or data to support that conclusion. Just quotes from centrist Dems who say *they* don't want to talk about it. www.politico.com/news/2026/10...

The small handful of Democrats running anti-trans ads should be embarrassed now and will be embarrassed in time. I've been saying it and still think it — www.lawdork.com/p/dangerous-... — and people who compromise in this way will change or won't be leaders, even if they are in office.
I'm running out of ways to convey how unserious the lawyers at Trump's DOJ are. The dregs of the conservative legal movement firing up ChatGPT to cobble together harebrained arguments that would be embarrassing for a junior law firm associate. Get these losers out of my face.

The fact that Trump decided NOT to livestream an execution does not mean that the Supreme Court would have done anything to stop him
My armchair analysis of Supreme Court Retirement Watch is that I genuinely don't think Trump wanted or wants Alito or Thomas to retire, because Alito and Thomas are already the Trump administration's de facto representatives on the Court, and I'm not sure he could find anyone better
Could Trump find *a* more MAGA-brain-poisoned lawyer to put on the Supreme Court? Sure, James Ho and Josh Blackman exist. But those chuckleheads don't have the institutional power that Alito and Thomas have built within the conservative legal movement.
If you want to listen to @jduffyrice.bsky.social and I get upset about this exact problem for 51 minutes, I am going to share some excellent news with you soon
Well this is eleventy-million kinds of Fucked Up. @latimes.com (who once contracted with me as a freelance reviewer and whom I struggled to get paid by) asserts that *merely reading its website* constitutes a permanent waiver of your right to sue it under *any circumstances*.
I am fascinated by the zero-charisma chuds who during the Trump administration find themselves briefly in positions of power and relevance. An inspiration for thumbs everywhere. ballsandstrikes.substack.com/p/donald-tru...
You have to hold two things in your head at once here: This is embarrassing shit that will get laughed out of court, and also, the fact that the president is even trying it is fucking terrifying www.washingtonpost.com/national-sec...
The Republican Party's closing message to voters is basically "there is a non-zero chance that we will send armed state agents to drag you from your home if you try to participate in democracy." Vile and pathetic.
Personally, if I were a standards editor at The New York Times, I'm not sure I would have given Josh Blackman a platform to complain about being described as a "conservative" law professor, and definitely would not have told him how smart and correct he is to do so www.nytimes.com/2026/10/22/i...
This is so funny. All Josh wanted to do was write a The New York Times Listened to Me and Said I Was Right post, and you gave it to him. Rube shit. Embarrassing.
Yes, I really enjoyed the part where they discuss the scourge of "dial-a-quote" professors who will do anything to get mentioned by a reporter, because it was like, man, do you really not understand that that is all that Josh Blackman is and has ever been??
The funny part is that by any measure, liberal or conservative, Josh is an outlier.
It's very funny that the conservative legal movement lionizes Clarence Thomas as this intellectual powerhouse, when everything he's written lately indicates that he's just another elderly Republican who watches too much Newsmax at home. A Trump yes-man running out the clock.
As usual, the answer to "What am I supposed to do with the worst thing in my inbox this week" is "make you all look at it," so: Here is a Supreme Court game that requires you to do oral argument in real cases while pixelated AI versions of the justices get annoyed and ask you questions
At this point, I do not think there is anything Trump can ask for that Sam Alito and Clarence Thomas wouldn't give him. If Trump's actual lawyers were on the Supreme Court, they would not be doing anything differently

Bluesky I know you do not care about golf. But I am telling you that in this specific case, you SHOULD care about golf. I explain in @slate.com what the Trump administration is doing to East Potomac Golf Course in D.C. slate.com/culture/2026...

I am convinced that the conservative justices are hypersensitive about "reverse discrimination" cases from D.C.-area schools because it's an issue that their fellow wealthy lawyers complain loudly about at cocktail parties

Sam Alito is whitewashing the racist history of originalism again
In retrospect, Sam Alito is about as obvious a Problematic Statues Defender as it gets. I regret not picking up on this sooner. The most enthusiastic "heritage not hate" guy in the entire greater Philadelphia area.
As a lifelong West Coaster I was an outsider and a late-arriving appreciator of country, but yeah once I explored the space and learned how much more (SO much more) it is than a white guy named Brantley singing about truck beers, I was in. Lesson learned for sure.
