So if you're following, DOJ's theory here is they can file an initial complaint with probable cause based on incorrect facts, then file a superseding complaint that removes those facts and proceed without probable cause. Novel indeed.

For reference, current 4A jurisprudence allows an LEO to arrest a person without personal knowledge that constitutes PC so long as someone in the dept has knowledge that could clear the PC bar. The DoJ here is asking for that level of tortured constitutional analysis. I am agog.

I think that another framing of this could be that everything that everyone in this ecosystem says is a lie, but sometimes the lie becomes something real. The very real danger is that if you lie long enough, and if you live that lie long enough, you cannot distinguish between the lie and reality.
