Well, luckily it's been established that a government can kill people in a boat if they think they might be doing something bad.

According to what we read the US kills people on boats in international waters, the US just say they are drug smugglers. I suppose any small boat in international or Cuban waters can be sunk and the occupants killed, just say they are US drug smugglers. No need for a trial.
